Frequently asked questions

How many days of annual leave is an employee entitled to in Kenya?

The Employment Act 2007 gives at least 21 working days of paid annual leave after each 12 months of continuous service. Many employers give more. Spread over a year, 21 days builds up at 1.75 days a month.

How is leave pay worked out?

Divide the monthly salary by the number of working days you use, usually 26 or 30, to get the daily rate, then multiply by the days of leave. The calculator lets you pick 26 or 30. Use what your contract or payroll policy says.

Is untaken leave paid when someone leaves?

Leave that has been earned and not taken is normally paid out when employment ends. The final dues calculator adds it to unpaid salary, notice pay and service or severance pay.

Can leave be carried over?

That depends on your contract and leave policy. Enter the days carried over so they are included in the balance. Check the policy for any limit on how many days can be carried over.

Is this legal advice?

No. It is a general guide using the Employment Act 2007 and the figures you enter. Your contract, collective agreement or policy may give more than the minimum.
