Frequently asked questions

What is included in final dues in Kenya?

Usually salary for days worked and not yet paid, pay for annual leave not taken, notice pay if the employer ends the contract without giving notice, service pay where it applies, and severance pay on redundancy. Money the employee owes the employer, such as an advance, can be deducted where the contract or law allows it.

Do NSSF members get service pay?

Under Section 35 of the Employment Act, service pay does not apply to employees who are members of the NSSF, or of certain pension or provident schemes. Where it does apply, it is at least 15 days' pay for each completed year of service. Choose the NSSF option in the calculator to match your case.

How is severance pay worked out on redundancy?

Section 40 of the Employment Act sets severance pay at not less than 15 days' pay for each completed year of service. It is paid in addition to notice and any leave or salary owed. The employer must also give the employee and the labour officer at least one month's notice of the redundancy.

How much leave pay is due?

Annual leave is at least 21 working days a year, which builds up at 1.75 days a month. Leave earned and not taken is normally paid out at the end of employment. The calculator uses the daily rate you choose, which is monthly salary divided by 26 or by 30.

Is tax taken off final dues?

Yes. Most final dues are taxable pay, so PAYE and the statutory deductions apply. The figure here is before tax. To see the take-home, run the amounts through the Kenya payroll calculator.

Is this legal advice?

No. It is a general guide using the Employment Act 2007 and the figures you enter. Contracts, collective agreements and company policy can give more than the minimum, so check the signed contract.
